Terms and conditions of business

Please read our terms and conditions of business carefully and if you have any questions at all please do get in touch with our team.

Contract period

The contract term is for the period stated and starts from the date your advertising goes live. Upon reaching the end of the contract period, your advertising will continue until terminated. If you wish to terminate after the minimum contract period, this can be done by giving 30 days notice in writing by email to info@fisheries.co.uk. The standard contract periods for advertising are as follow:

  • Fisheries – 12 months from when the advertising goes live.
  • Holidays – 12 months from when the advertising goes live.
  • Fisheries / property for sale – No minimum period for advertising, your listing will remain on the site until asked to remove or marked as sold. Commission only advertising will be agreed by separate agreement.

Content, materials and copyright

We retain the copyright to all the content that we create for you, including but not limited to images, written text and videos produced by us. We also retain the copyright of all of the content on our website, except any material that you have provided to us, such as your own images, for which you retain copyright. You agree that for any content you supply to us, you have full permission and copyright to do so. We cannot accept any responsibility and have no liability, whatsoever, for any third party content however it is provided to us.

Amendments and Accuracy

When creating content for your advertising we will make best efforts to ensure the accuracy of this information. Before your advertising goes live on our website we will ask you to check and confirm you are happy with it. We cannot be held liable for and do not accept, under any circumstances, any liability for any inaccuracies or incorrect information in your advertising once you have agreed for your advertising to go live.

If you require any amendments to your advertising, you can request changes via phone or email where one of our team will update your advertising for you. We allow for four changes a year. Further changes may incur additional costs, of which we will notify you before making any changes. You are responsible for advising us of any changes that you wish to make, either by telephone or by email to info@fisheries.co.uk

Limitation of liability

We care about generating a good ROI and effective marketing for all our customers, but under no circumstances will we be liable for any direct, indirect, special, consequential or punitive damages (including loss of profits) arising out of or relating to these terms.

Fees, payment terms and invoices

The price for your advertising is fixed for the initial period of this contract period, after which we will be entitled to change our pricing or fees if the need arises. We’ll never change our prices without telling you first and we’ll always be up front and clear about this.

The set up fee is due immediately on confirmation of your order. Any monthly fee will be due on the 1st of the month following your advertising going live on our website. All fees are collected by direct debit unless a specific arrangement has been made with you. Invoices will be provided for the set up fee, annual or monthly fee and sent to you via email. Any taxes, VAT and applicable charges will be included on the invoice. Non payment of fees will not constitute cancellation or termination of this contract and we reserve the right to charge interest at the Bank of England’s base rate on debt over 90 days.

Termination / cancellation

Our contracts can be terminated at any time by you by writing to us via email and paying any balance remaining on the contract period. After the contract period, advertising can be terminated by giving us 30 days notice in writing via email to info@fisheries.co.uk. Termination requests sent by email will receive a response by one of the team. This response confirms receipt of the email. If you do not get a response within five working days please contact us by phone on 07970 490347 to confirm that your termination request has been received.

Miscellaneous

Waiver – In case Fisheries Limited fails to enforce the terms laid out in this document, or any of the specific provisions of a contract, such waiver will neither preclude any other or further enforcement of such provision(s), nor the exercise of any other right hereunder.

Normal Communication

All communications between Fisheries Ltd shall be made by phone, through the email address info@fisheries.co.uk, or in writing to the address Fisheries Ltd, Union House, 111 New Union Street, Coventry, West Midlands, United Kingdom CV1 2NT

Notices

All Notices, request and demands and other communication, other than normal communication, shall be in writing and be deemed to be given if:

  • Delivered personally;
  • Delivered by a courier express delivery service, on the day of delivery;
    or by certified or registered mail, postage paid, return receipt requested, and confirmed delivery on the date of confirmation, or 3 days after mailing.

Force Majeure

Neither party shall bear any liability for any failure or delay in the performance of their obligations if such delay or failure to perform is due to any Force Majeure. Force Majeure shall be defined as: any act, omissions, cause or circumstance beyond the reasonable control of the parties, this to include without any limitations; acts of God, war, national emergency, protests or rebellion, civil commotion, riots or strikes and any form of industrial dispute, (whether or not involving either parties work force , earthquake, flood, drought, epidemic, fire, explosion, act of terrorism, pandemic or epidemic, or any other act ordered by any government, council or constituted body.

Rights of third parties

Only Fisheries Ltd and the Client may enforce these terms.

Jurisdiction and applicable law

Under these terms and all matters resulting from it will be governed by and construed in accordance with the laws of England and Wales. All parties will irrevocably submit to the exclusive jurisdiction of the courts England and Wales, except where provided for under these terms.
